Terms of Service

These General School Terms of Service (“Terms”) govern access to and use of Thinking Nation’s educational platform, curriculum resources, assessments, reporting tools, professional development, and related services by schools, districts, educators, administrators, students, and other authorized users.
By accessing or using Thinking Nation’s services, the school, district, or authorized user agrees to these Terms, any applicable order form, statement of work, invoice, data privacy agreement, privacy policy, and any additional written terms agreed to by the parties.
1. Services
Thinking Nation provides educational products and services designed to support history and social studies instruction, writing development, assessment, feedback, reporting, and related instructional activities.
Services may include, but are not limited to:
- Curriculum resources
- Writing-based assessments
- AI-supported feedback and grading tools
- Teacher and administrator reporting
- Professional development
- School or district rostering and integrations
- Student learning data and performance reports
Specific services, pricing, access levels, implementation details, and subscription terms may be described in a separate order form, partner agreement, invoice, statement of work, or other written agreement.
2. Authorized Users
Access to Thinking Nation services is limited to authorized school or district users, including students, teachers, school administrators, district administrators, and approved staff.
The school or district is responsible for ensuring that only authorized users access the services and that all users comply with these Terms.
Users may not share login credentials, access links, accounts, or platform access with unauthorized individuals.
3. License and Permitted Use
Thinking Nation grants the school or district a limited, non-exclusive, non-transferable, revocable license to access and use the services during the applicable subscription or agreement term.
The services may only be used for internal educational purposes by the school, district, and its authorized users.
The school, district, and users may not sell, sublicense, publish, distribute, transfer, copy, modify, reverse engineer, scrape, or create derivative works from Thinking Nation’s platform, curriculum, assessments, reports, software, AI tools, or related materials without prior written permission from Thinking Nation.
4. School and District Responsibilities
The school or district agrees to:
- Provide accurate rostering, enrollment, and user information as needed for implementation.
- Ensure that authorized users are informed of applicable platform expectations.
- Maintain the confidentiality of student data, login credentials, and access links.
- Use reasonable efforts to prevent unauthorized access or misuse.
- Notify Thinking Nation promptly of any suspected unauthorized use, data issue, security concern, or misuse of the services.
- Comply with all applicable laws, policies, and privacy requirements related to student data and educational technology use.
5. Thinking Nation Responsibilities
Thinking Nation will provide access to the services in accordance with the applicable agreement, order form, subscription, or written arrangement.
Thinking Nation will use reasonable efforts to provide training, support, platform maintenance, and implementation assistance as needed for proper use of the services.
Thinking Nation will maintain user data in accordance with its Privacy Policy, applicable data privacy agreements, and applicable law.
6. Privacy and Data Handling
Thinking Nation collects, uses, stores, and protects personal information and user data in accordance with its Privacy Policy and applicable law.
Schools and districts are responsible for obtaining any required consents, approvals, or authorizations necessary for student access and use.
Thinking Nation may use data to provide the services, support instruction, generate reports, improve platform functionality, maintain security, troubleshoot issues, and fulfill contractual obligations.
Thinking Nation will not sell student personal information.
7. Student Data and Reports
Thinking Nation may process student submissions, assessment responses, writing samples, scores, feedback, usage activity, and related performance data for educational purposes.
Reports may be made available to authorized teachers, administrators, schools, or districts depending on the school’s implementation, rostering structure, and access permissions.
Schools and districts are responsible for reviewing user access and ensuring that only appropriate staff have access to student data.
8. AI-Supported Feedback and Assessment
Some Thinking Nation services may include AI-supported feedback, grading support, rubric-based evaluation, or automated instructional insights.
AI-supported outputs are intended to support teaching, learning, and instructional review. They should not be treated as the sole basis for high-stakes decisions about students.
Thinking Nation may update, improve, or modify AI-supported features over time to improve accuracy, consistency, usability, and instructional value.
9. User Content
Users may submit writing, responses, files, comments, or other content through the services.
The school or district is responsible for ensuring that user-submitted content is appropriate, lawful, and does not infringe the intellectual property, privacy, or other rights of any person or organization.
Thinking Nation may store and process user content as necessary to provide the services, generate feedback, support reporting, troubleshoot issues, improve platform functionality, and fulfill contractual obligations.
10. Intellectual Property
All Thinking Nation curriculum, assessments, rubrics, software, platform features, reports, designs, logos, trademarks, instructional materials, AI tools, documentation, and related content are owned by Thinking Nation or its licensors.
No ownership rights are transferred to the school, district, or users.
Schools and users may not copy, reproduce, distribute, publicly display, modify, resell, or commercially exploit Thinking Nation materials unless expressly authorized in writing.
11. Prohibited Uses
Users may not:
- Share accounts, login links, or credentials.
- Access the services without authorization.
- Use the platform for unlawful, harmful, or non-educational purposes.
- Attempt to bypass security controls.
- Upload malicious code, viruses, or harmful files.
- Scrape, decompile, reverse engineer, or copy platform functionality.
- Use Thinking Nation content to create a competing or substitute product.
- Post, upload, or submit content that violates intellectual property, privacy, school policies, or applicable law.
- Interfere with platform performance or other users’ access.
12. Third-Party Services and Integrations
Thinking Nation may integrate with or rely on third-party services, including rostering, single sign-on, hosting, analytics, support, communications, or payment tools.
Use of third-party services may be subject to additional terms and privacy practices from those providers.
Thinking Nation is not responsible for third-party services outside of its reasonable control.
13. Fees, Payment, and Subscription Terms
Fees, payment schedules, subscription periods, implementation costs, professional development fees, and other charges will be described in the applicable order form, invoice, statement of work, or written agreement.
Unless otherwise stated in writing, payments are due according to the terms listed on the invoice or agreement.
Access may be suspended or terminated for nonpayment, unauthorized use, or material breach of these Terms.
14. Renewals, Cancellations, and Refunds
The subscription term, renewal process, cancellation rights, and refund eligibility will be governed by the applicable order form, partner agreement, invoice, statement of work, or written agreement.
Unless expressly stated otherwise, fees are non-refundable once services have been made available or the subscription term has begun.
15. Support
Thinking Nation may provide help desk support, onboarding assistance, professional development, troubleshooting, and implementation support as described in the applicable agreement or service plan.
Support requests may require collection of information such as name, email address, school, role, account information, issue details, and related technical information.
16. Availability and Changes to Services
Thinking Nation may update, modify, enhance, suspend, or discontinue features of the services from time to time.
Thinking Nation will use reasonable efforts to maintain platform availability but does not guarantee uninterrupted or error-free access.
Scheduled maintenance, technical issues, third-party service interruptions, school network restrictions, or events outside Thinking Nation’s control may affect availability.
17. Disclaimer of Warranties
The services are provided on an “as is” and “as available” basis unless otherwise stated in a written agreement.
Thinking Nation does not guarantee that the services will be uninterrupted, error-free, or meet every school, district, teacher, or student need.
Thinking Nation does not guarantee specific academic outcomes, assessment results, student performance improvements, or standardized test results.
18. Limitation of Liability
To the fullest extent permitted by law, Thinking Nation will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from use of the services.
Where liability cannot be excluded, Thinking Nation’s total liability will be limited to the amount paid by the school or district for the services during the applicable subscription period, unless otherwise required by law or agreed to in writing.
19. Termination
Thinking Nation may suspend or terminate access if the school, district, or user violates these Terms, fails to pay applicable fees, misuses the services, compromises security, infringes intellectual property rights, or creates legal or operational risk.
Upon termination, access to the services will end, and the school or district must stop using Thinking Nation materials except as otherwise permitted in writing.
20. Copyright and Infringement
Thinking Nation respects intellectual property rights and requires users to do the same.
Users may not upload, submit, distribute, or use content through the services in a way that infringes copyright, trademark, privacy, or other proprietary rights.
If a school, district, user, or third party believes that content made available through Thinking Nation’s services infringes intellectual property rights, they may submit a written notice to Thinking Nation using the contact information provided on Thinking Nation’s website or in the applicable agreement.
Thinking Nation may remove or restrict access to content that it reasonably believes violates these Terms, infringes intellectual property rights, or creates legal, security, or operational risk.
21. Governing Law and Dispute Resolution
Unless otherwise stated in a separate signed agreement, these Terms will be governed by the laws of the State of California and applicable United States law.
The parties agree to make reasonable good-faith efforts to resolve disputes informally before pursuing formal legal remedies.
22. Changes to These Terms
Thinking Nation may update these Terms from time to time.
Continued use of the services after updated Terms are posted or provided constitutes acceptance of the updated Terms.
